Michigan Woman Sues Ohio Amusement Park Over Brain Injury Caused by Roller Coaster Incident

Rachel Hawes, a woman from Michigan, has taken legal action against Cedar Fair, a major amusement park company, after claiming that she suffered a traumatic brain injury from a falling roller coaster part at Cedar Point in Sandusky, Ohio. The incident has sparked concerns about park safety and accountability.

The Roller Coaster Incident and Closure

Hawes was struck by a piece of metal that detached from the Top Thrill Dragster roller coaster at Cedar Point in August 2021. She was immediately taken to a nearby hospital for treatment. In response to the incident, Cedar Point decided to permanently close the roller coaster in September 2022 due to safety concerns.

Allegations Against Cedar Point

Hawes’ lawsuit accuses Cedar Point of negligence in inspecting and maintaining the Top Thrill Dragster roller coaster. She claims that the park’s failure to exercise reasonable care resulted in severe injuries, including skull fractures and a traumatic brain injury. The lawsuit aims to hold Cedar Point responsible for rider safety.

Medical Expenses and Future Care

The lawsuit highlights the considerable medical expenses that Hawes has incurred, which have already exceeded $2 million. It further states that her future medical care and treatment are estimated to cost over $10 million. Hawes’ traumatic brain injury has significantly impacted her life, requiring assistance with daily activities. The lawsuit seeks compensation for the damages she has suffered and will continue to endure.

Legal Action and Damages

Hawes is seeking judgment against Cedar Fair, the parent company of Cedar Point, to cover various damages. These include medical expenses, loss of wages, lost earning potential, physical pain, emotional distress, and other losses resulting from the incident. The lawsuit has been filed in the Erie County, Ohio, Common Pleas Court.
